{"data":{"id":"us-ky/krs-304.17a-148","jurisdiction":"us-ky","citation":"KRS 304.17A-148","heading":"Coverage for diabetes -- Cap on cost-sharing requirements for insulin.","body":"(1) All health benefit plans issued or renewed on or after January 1, 2022, shall provide\ncoverage for equipment, supplies, outpatient self -management training and\neducation, including medical nutrition therapy, and all medications necessary for the\ntreatment of insulin-dependent diabetes, insulin-using diabetes, gestational diabetes,\nand noninsulin -using diabetes if prescribed by a health care provider legally\nauthorized to prescribe the items.\n(2) Diabetes outpatient self -management training and education shall be provided by a\ncertified, registered, or licensed health care professional with expertise in diabetes,\nas deemed necessary by a health care provider.\n(3) (a) Except as provided in paragraph (b) of this subsection, the benefits provided\nin this section shall be subject to the same annual deductibles or coinsurance\nestablished for all other covered benefits within a given health benefit plan.\n(b) Cost sharing for  a covered prescription insulin drug shall not exceed thirty\ndollars ($30) per thirty (30) day supply of each prescription insulin drug,\nregardless of the amount or type of insulin needed to meet the covered\nperson's insulin needs.\n(c) Private third -party payors may not reduce or eliminate coverage due to the\nrequirements of this section.\n(d) Except as provided in KRS 18A.225, paragraph (b) of this subsection shall not\napply to governmental plans, as defined in KRS 304.17A -005, that are self -\ninsured.\n(e) Nothing in this subsection shall prevent an insurer from establishing cost -\nsharing requirements for covered prescription insulin drugs below the amount\nspecified in paragraph (b) of this subsection.\n(4) As used in this section, \"cost sharing\" has the same me aning as in KRS 304.17A -\n164.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51776","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:46Z","sha256":"c3b4726ec89dffb433891cbf57c1f1521e37fd146439fa68cad88b3ede9eb94f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-1473","next":"us-ky/krs-304.17a-149"},"notice":"GroundRules: Original legal text.
