{"data":{"id":"us-ky/krs-304.17a-168","jurisdiction":"us-ky","citation":"KRS 304.17A-168","heading":"Coverage for tobacco cessation medications and services.","body":"(1) Notwithstanding any provision of law to the contrary, a health benefit plan shall, at\na minimum, provide coverage for all United States Food and Drug Administration -\napproved tob acco cessation medications, all forms of tobacco cessation services\nrecommended by the United States Preventive Services Task Force, including but\nnot limited to individual, group, and telephone counseling, and any combination\nthereof.\n(2) The following co nditions shall not be imposed on any tobacco cessation services\nprovided pursuant to this section:\n(a) Counseling requirements for medication;\n(b) Limits on the duration of services, including but not limited to annual or\nlifetime limits on the number of covered attempts to quit; or\n(c) Copayments or other out-of-pocket cost sharing, including deductibles.\n(3) Utilization management requirements, including prior authorization and step\ntherapy protocol, shall not be imposed on any tobacco cessation services provided\npursuant to this section, except in the following circumstances where prior\nauthorization may be required:\n(a) For a treatment that exceeds the duration recommended by the most recently\npublished United States Public Health Service clinical practi ce guidelines on\ntreating tobacco use and dependence; or\n(b) For services associated with more than two (2) attempts to quit within a\ntwelve (12) month period.\n(4) Nothing in this section shall be construed to prohibit a plan or issuer from providing\ncoverage for tobacco cessation services in addition to those recommended or to\ndeny coverage for services that are not recommended by the United States\nPreventive Services Task Force.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53228","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:46Z","sha256":"3d8ea8d5a3caa13c5c89a4f46c427648af2f38ba81b5dfa7ec11f0e70a14bcfb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-167","next":"us-ky/krs-304.17a-170"},"notice":"GroundRules: Original legal text.
