{"data":{"id":"us-ky/krs-304.17a-170","jurisdiction":"us-ky","citation":"KRS 304.17A-170","heading":"Definitions for KRS 304.17A-170 and 304.17A-171.","body":"As used in this section and KRS 304.17A-171, unless the context requires otherwise:\n(1) \"Health benefit plan\" has the meaning provided in KRS 304.17A-005.\n(2) \"Primary chiropractic provider\" means a chiropractor licensed pursuant to KRS\nChapter 312 who has  been selected by a person covered by a health benefit plan to\nprovide chiropractic service and who agrees to provide within the statutory scope of\ntheir respective practices these services in accordance with the terms, conditions,\nreimbursement rates, and standards of quality as set forth within the specific health\nbenefit plan.\n(3) \"Participating chiropractic provider\" means a primary chiropractic provider who has\ncontracted with a health insurer to provide chiropractic services within the proper\nscope of practice to persons insured under the health benefit plan of the insurer.\n(4) \"Chiropractic benefits\" means those services that are provided by a primary\nchiropractic provider who is functioning within the statutory scope of practice.\n(5) \"Gatekeeper system\" means a system of administration used by any health benefit\nplan in which a primary care provider furnishes basic patient care and coordinates\ndiagnostic testing, indicated treatment, and specialty referral for persons covered by\nthe health benefit plan.\n(6) \"Gatekeeper\" means a covered person's primary care provider in a gatekeeper\nsystem.\n(7) \"Health care insurer\" means any entity, including but not limited to insurance\ncompanies, hospital and medical services corporations, health maintenance\norganizations, preferred provider organizations, and physician hospital\norganizations, that is authorized by the state of Kentucky to offer or provide health\nbenefit plans, policies, subscriber contracts, or any other contracts of similar nature\nwhich indemnify or  compensate health care providers for the provision of health\ncare services.\n(8) \"Covered persons\" means any individual or family who is enrolled in a health\nbenefit plan or policy from a health care insurer and on whose behalf the health care\ninsurer is obligated to pay for or provide chiropractic services.\n(9) \"Covered service\" means those health care services including chiropractic services\nwhich the health care insurer is obligated to pay for or provide to covered persons\nunder the health benefit plan o r policy or pursuant to KRS 304.17 -305 or 304.18 -\n095.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17389","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:46Z","sha256":"dcbd235e81a9c9840730d774262e8d76392d9c235ebb5780620b79a6c7d89f46","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-168","next":"us-ky/krs-304.17a-171"},"notice":"GroundRules: Original legal text.
