{"data":{"id":"us-ky/krs-304.17a-171","jurisdiction":"us-ky","citation":"KRS 304.17A-171","heading":"Requirements for health benefit plans that include chiropractic","body":"benefits.\nA health benefit plan that includes chiropractic benefits shall:\n(1) Include all primary chiropractic providers who are selected by covered persons of\nthe plan for the provision of all chiropractic benefits provided by the plan which fall\nwithin the statutory scope of practice of the respective primary chiropractic\nprovider.\n(2) Permit any licensed chiropractor who agrees to abide by the terms, conditions,\nreimbursement rates, and standards of quality of the health benefit plan to serve as a\nparticipating primary chiropractic provider to any person covered by the plan.\n(3) Guarantee that all covered persons who are eligible for chiropractic benefits under a\nhealth benefit plan  shall have direct access to the primary chiropractic provider of\ntheir choice independent of, and without referral from, any other provider or entity.\n(4) Assure that those plans utilizing a gatekeeper system shall designate the primary\nchiropractic provi der within the scope of practice as the gatekeeper, who shall\nprovide basic patient care and coordinate diagnostic testing, indicated treatment,\nand specialty referral for those covered persons in the provision of chiropractic\nbenefits. Nothing in KRS 304. 17A-170 or this section shall prevent a covered\nperson from having direct access to that person's primary care provider (gatekeeper)\nfor treatment and being reimbursed in accordance with the terms and fee schedule\nof the health benefit plan.\n(5) Not discriminate between individual providers or classes of providers in the amount\nof reimbursement, copayment, or other financial compensation for the same or\nessentially similar services provided by the health benefit plan.\n(6) Not promote or recommend any indivi dual provider or class of providers to a\ncovered person by any method or means.\n(7) Assure that an adequate number of primary chiropractic providers are included as\nparticipating chiropractic providers to guarantee reasonable accessibility, timeliness\nof care, convenience, and continuity of care to covered persons.\n(8) Make available to covered persons a listing of all participating primary chiropractic\nproviders, their practice location and telephone number on a regular, timely basis.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17390","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:46Z","sha256":"a93b7e6e474c37dc457e5fe5e97e3e92114f0db25d4a1d32b6e0b79b3cbd6b5f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-170","next":"us-ky/krs-304.17a-172"},"notice":"GroundRules: Original legal text.
