{"data":{"id":"us-ky/krs-304.17a-230","jurisdiction":"us-ky","citation":"KRS 304.17A-230","heading":"Pre -existing condition exclusion in individual market -- Prohibition","body":"against use of genetic information -- Administrative regulations.\n(1) A health insurer offering individual health benefit plan coverage in the individual\nmarket in the Commonweal th shall not impose any pre -existing conditions\nexclusions as to any eligible individual.\n(2) Each health insurer offering individual health benefit plan coverage in the\nindividual market in the Commonwealth that chooses to impose a pre -existing\nconditions exclusion on individuals who do not meet the definition of eligible\nindividual shall comply with the provisions of KRS 304.17A-220, which establishes\nstandards and requirements for pre -existing conditions exclusions for group health\nplans, including credi ting previous coverage, and certification of coverage.\nPregnancy may be considered to be a pre-existing condition.\n(3) Genetic information shall not be treated as a pre-existing condition in the absence of\na diagnosis of the condition related to the information.\n(4) The Department of Insurance shall promulgate administrative regulations necessary\nto carry out the provisions of this section and KRS 304.17A-220.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17396","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:46Z","sha256":"b184eec9483c83fbd4791b1961353a67dbf0fceb27ea9efbe67b2743753f157e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-220","next":"us-ky/krs-304.17a-235"},"notice":"GroundRules: Original legal text.
