{"data":{"id":"us-ky/krs-304.17a-252","jurisdiction":"us-ky","citation":"KRS 304.17A-252","heading":"Health benefit plan not required to include state -mandated benefits","body":"enacted after issuance.\n(1) Notwithstanding any other provision of law to the contrary, an insurer that issues or\nrenews a health benefit plan on or after January 1, 2005, and bef ore December 31,\n2007, shall not be required to include any additional state mandated benefit beyond\nthose statutory requirements in effect for health benefits plans on January 1, 2005.\n(2) An insurer issuing or renewing a health benefit plan may elect to expand coverage\non any group, individual, or association health benefit plan.\n(3) An insurer issuing or renewing a health benefit plan shall not suspend, limit, or\nmodify any state mandated benefit in effect on January 1, 2005.\n(4) An insurer issuing or re newing a health benefit plan shall not suspend, limit, or\nmodify any federal mandated benefit in effect on January 1, 2005, or any federal\nmandated benefit that becomes effective after January 1, 2005.\n(5) Nothing in this section shall affect the fiscal im pact statement required by KRS\n6.948 to be attached to any legislation mandating health insurance benefits.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17401","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:46Z","sha256":"0a7af9db5593428670ca7f5e1c776509dc9492bce3b772d66b0ec82c5e262d2f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-250","next":"us-ky/krs-304.17a-254"},"notice":"GroundRules: Original legal text.
