{"data":{"id":"us-ky/krs-304.17a-257","jurisdiction":"us-ky","citation":"KRS 304.17A-257","heading":"Coverage under health benefit plan for colorectal cancer","body":"examinations and laboratory tests.\n(1) A health benefit plan shall provide coverage for all colorectal cancer examinations\nand laboratory tests specified in the most recent ve rsion of the American Cancer\nSociety guidelines for individuals referenced in paragraph (b)1. of this subsection\nand the most recent version of the United States Multi -Society Task Force on\nColorectal Cancer guidelines for individuals referenced in paragra ph (b)2. of this\nsubsection for complete colorectal cancer screening of asymptomatic individuals as\nfollows:\n(a) Coverage or benefits shall:\n1. Include coverage for all United States Food and Drug Administration -\napproved bowel preparation prescribed in con nection with a colorectal\ncancer examination or laboratory test; and\n2. Be provided for all colorectal cancer examinations and laboratory tests\nadministered at a frequency identified in the relevant guidelines; and\n(b) The covered individual shall be:\n1. Forty-five (45) years of age or older; or\n2. Less than forty -five (45) years of age and at high risk for colorectal\ncancer.\n(2) (a) Except as provided in paragraph (b) of this subsection, the coverage required\nby this section shall not be subject to:\n1. Prior authorization; or\n2. A deductible, coinsurance, or any other cost -sharing requirements for\nservices received from participating providers under the health benefit\nplan.\n(b) If the application of any requirement of paragraph (a)2. of this subsection\nwould be the sole cause of a health benefit plan's failure to qualify as a Health\nSavings Account-qualified High Deductible Health Plan under 26 U.S.C. sec.\n223, as amended, then the requirement shall not apply to that health benefit\nplan until the minimum deductible under 26 U.S.C. sec. 223, as amended, is\nsatisfied.\n(3) This section shall not be construed to limit coverage required by KRS 304.17A -259\nor any other law.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56665","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:47Z","sha256":"8d88d45cce144b484715cc184af0f46e775838567d3bcc37e763df3d85a6dd4f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-256","next":"us-ky/krs-304.17a-258"},"notice":"GroundRules: Original legal text.
