{"data":{"id":"us-ky/krs-304.17a-259","jurisdiction":"us-ky","citation":"KRS 304.17A-259","heading":"Coverage under health benefit plan for genetic test for cancer risk.","body":"(1) As used in this section, \"genetic test for cancer risk\" means a blood, saliva, or tissue\ntyping test that reliably determines the presence or absence of an inherited genetic\ncharacteristic that is generally accepted in the medical or scientific communi ty as\nbeing associated with a statistically significant increased risk of cancer\ndevelopment.\n(2) (a) All health benefit plans issued or renewed on or after January 1, 2020, shall\ncover any genetic test for cancer risk that is recommended by any of the\nfollowing, if the recommendation is consistent with the most recent version of\ngenetic testing guidelines published by the National Comprehensive Cancer\nNetwork (NCCN):\n1. A physician, physician assistant, or genetic counselor licensed under\nKRS Chapter 311; or\n2. An advanced practice registered nurse licensed under KRS Chapter 314.\n(b) The commissioner may extend the coverage required by paragraph (a) of this\nsubsection to include recommendations that are consistent with the most\nrecent version of genetic tes ting guidelines or criteria published by additional\nnational medical societies, if the guidelines or criteria are determined by the\ncommissioner to be relevant and reliable.\n(3) Coverage required by this section shall:\n(a) Not be subject to a deductible, c oinsurance, or any other cost -sharing\nrequirements; and\n(b) Include coverage at the health benefit plan's average in -network rate for out -\nof-network providers or laboratories if there are no in -network providers or\nlaboratories available to provide the covered test.\n(4) This section shall not be construed to limit coverage required by KRS 304.17A -257\nor any other law.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49487","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:47Z","sha256":"4927c7b51e6c20c39784d00aacc83ff377e944a6a2d074e16f559c70e88eb5be","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-258","next":"us-ky/krs-304.17a-260"},"notice":"GroundRules: Original legal text.
