{"data":{"id":"us-ky/krs-304.17a-555","jurisdiction":"us-ky","citation":"KRS 304.17A-555","heading":"Patient's right of privacy regarding mental health or chemical","body":"dependency -- Authorized disclosure.\nThere is hereby recognized a patient's right of privacy in the content of a patient's record\nand communications between a patient and a health care  provider with regard to mental\nhealth or chemical dependency.\n(1) An insurer may request the provider to furnish the insurer only such limited\ninformation concerning the patient from a patient's record as is necessary for\ndetermining covered services and benefits, medical necessity, appropriateness, and\nquality of care for authorization or continuation of mental health and chemical\ndependency health services to be provided to the patient, or for payment for those\nservices.\n(2) No third party to whom disclo sure of patient records is made by a provider may\nredisclose or otherwise reveal the mental health and chemical dependency records\nof a patient, beyond the purpose for which the disclosure was made, without first\nobtaining the patient's specific written consent to the redisclosure.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17440","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:47Z","sha256":"46d75919088c7c345c6ca81f33818171bd3342e88d41c3f20b6f0d0ac79b264f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-550","next":"us-ky/krs-304.17a-560"},"notice":"GroundRules: Original legal text.
