{"data":{"id":"us-ky/krs-304.17a-580","jurisdiction":"us-ky","citation":"KRS 304.17A-580","heading":"Education of insured about appropriate use of emergency and","body":"medical services -- Coverage of emergency medical conditions and emergency\ndepartment services -- Emergency personnel to contact primary care provider\nor insurer -- Exclusion of limited-benefit health insurance policies.\n(1) An insurer offering health benefit plans shall educate its insureds about the\navailability, location, and appropriate use of emergency and other medical services,\ncost-sharing provisions for emergency services, and the availability of care outside\nan emergency department.\n(2) An insurer offering health benefit plans shall cover emergency medical conditions\nand shall pay for emergency department screening and stabilization services both in-\nnetwork and out -of-network without prior authorization for conditions that\nreasonably appear to a prudent layperson to constitute an emergency medical\ncondition based on the patient's presenting symptoms and condition. An insurer\nshall be prohibited from denying the emergency dep artment services and altering\nthe level of coverage or cost -sharing requirements for any condition or conditions\nthat constitute an emergency medical condition as defined in KRS 304.17A-500.\n(3) Emergency department personnel shall contact a patient's prim ary care provider or\ninsurer, as appropriate, to discuss follow -up and poststabilization care and promote\ncontinuity of care.\n(4) Nothing in this section shall apply to accident -only, specified disease, hospital\nindemnity, Medicare supplement, long -term ca re, disability income, or other\nlimited-benefit health insurance policies.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49557","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:47Z","sha256":"8963e3259643c02691588057a3a4bcb77e4263b4b7bd2d7277e356dd2d197e7a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-578","next":"us-ky/krs-304.17a-590"},"notice":"GroundRules: Original legal text.
