{"data":{"id":"us-ky/krs-304.17a-593","jurisdiction":"us-ky","citation":"KRS 304.17A-593","heading":"Requirement to provide reasonably adequate and accessible","body":"pharmacy networks -- Annual report to commissioner -- Confidential\ninformation not subject to disclosure.\nTo the extent permitted under federal law:\n(1) (a) An insurer, a pha rmacy benefit manager, or any other administrator of\npharmacy benefits that utilizes a network to provide pharmacy or pharmacist\nservices under a health plan shall ensure that the network is reasonably\nadequate and accessible with respect to the provision of pharmacy or\npharmacist services.\n(b) A reasonably adequate and accessible network, with respect to the provision\nof pharmacy or pharmacist services, shall, at a minimum:\n1. Offer an adequate number of accessible pharmacies that are not mail -\norder pharmacies; and\n2. Provide convenient access to pharmacies that are not mail -order\npharmacies within a reasonable distance from the insured's residence,\nbut in no event shall the distance be more than thirty (30) miles from\neach insured's residence, to the exten t that pharmacy or pharmacist\nservices are available; and\n(2) (a) An insurer, a pharmacy benefit manager, and any other administrator of\npharmacy benefits conducting business in this state shall file with the\ncommissioner an annual report, in the manner an d form prescribed by the\ncommissioner, describing the networks of the insurer, pharmacy benefit\nmanager, or other administrator that are utilized for the provision of pharmacy\nor pharmacist services under a health plan.\n(b) The commissioner shall review ea ch network to ensure that the network\ncomplies with this section.\n(c) All information and data acquired by the department under this subsection\nthat is generally recognized as confidential or proprietary shall not be subject\nto disclosure under KRS 61.870 to 61.884, except the department may\npublicly disclose aggregated information not descriptive of any readily\nidentifiable person or entity.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55757","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:47Z","sha256":"7b5c7910e43aad7e2f384b0d4c79f4b0f7837586d591859468c6763caf9ccdeb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-591","next":"us-ky/krs-304.17a-595"},"notice":"GroundRules: Original legal text.
