(Effective\nJanuary 1, 2028)\nThe commissioner shall:\n(1) (a) Submit a written report not later than September 30 of  each year to the\nLegislative Research Commission for referral to the Interim Joint Committees\non Banking and Insurance and Health Services relating to prior authorization\nin the provision of health care benefits under this chapter.\n(b) The report required under paragraph (a) of this subsection shall include:\n1. Information relating to the implementation and effectuation of KRS\n304.17A-606;\n2. The number of insurers and private review agents offering a program\nrequired under KRS 304.17A-606;\n3. The number o f providers, by provider group, specialty, and county,\nparticipating in one (1) or more programs offered under KRS 304.17A -\n606;\n4. A list of health care services, which shall include a description and\nCurrent Procedural Terminology code for each service, f or which\nexemptions have been granted under the programs required under KRS\n304.17A-606;\n5. The number of programs offered under KRS 304.17A -606, which shall\ninclude:\na. The number of programs that grant exemptions for one (1) or more\nprescription drugs; and\nb. A list of the drugs for which exemptions are granted under a\nprogram reported under subdivision a. of this subparagraph; and\n6. With respect to any health insurance  policy, certificate, plan, or contract\nrequired to comply with KRS 304.17A-600 to 304.17A-633:\na. A list of all services, procedures, and other treatments, including\nprescription drugs, that require prior authorization;\nb. The percentage of prior authorization requests for nonurgent health\ncare services in aggregate and by specific service, procedure,\nprescription drug, and other treatment:\ni. That were approved without an extension;\nii. For which the review was extended and the request\napproved; and\niii. That were denied, which may include the reason or reasons\nfor the denials;\nc. The percentage of prior authorization requests for urgent health\ncare services that were:\ni. Approved; and\nii. Denied, which may include the reason or reasons for the\ndenials; and\nd. The average and median time between submission of a prior\nauthorization request and the prior authorization decision for:\ni. Nonurgent health care services; and\nii. Urgent health care services;\n(2) Provide the Interim Joint Committees on Banking and I nsurance and Health\nServices with a detailed briefing, upon request, to discuss and explain any report\nsubmitted under subsection (1) of this section; and\n(3) Promulgate any administrative regulation, including an emergency administrative\nregulation, in ac cordance with KRS Chapter 13A that the commissioner deems\nnecessary to implement this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58326","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:47Z","sha256":"92cd04892b55d4ae5e6287abd49ac31b4fced9b4fb155922ede3564ca3183289","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-606","next":"us-ky/krs-304.17a-607"},"notice":"GroundRules: Original legal text.
