{"data":{"id":"us-ky/krs-304.17a-704","jurisdiction":"us-ky","citation":"KRS 304.17A-704","heading":"Insurer's acknowledgment of receipt of claim -- Inaccurate or","body":"insufficient claim information -- Claim status information.\n(1) (a) Within forty -eight (48) hours of receiving an original or corrected claim\nsubmitted electronically, an insurer, its a gent, or designee shall acknowledge\nthe date of receipt of the claim by an electronic transmission to the provider,\nits billing agent, or designee that submitted the claim; and\n(b) Within twenty (20) calendar days of receipt of an original or corrected cla im\nsubmitted by mail or other nonelectronic means, an insurer, its agent, or\ndesignee shall acknowledge the date of receipt of the claim to the provider, its\nbilling agent, or designee that submitted the claim.\n1. For claims containing all necessary inform ation and having no errors,\nthe insurer shall make available confirmation of receipt of the claim to\nthe provider, its billing agent, or designee that submitted the claim.\nAcknowledgment may be in writing or the insurer, its agent, or designee\nmay list the  claim and the date it was received on a file that can be\naccessed electronically by the provider, its agent, or designee.\n2. Claims that contain errors or lack necessary information shall be\nacknowledged by an electronic transmission or in writing to the\nprovider, its billing agent, or designee that submitted the claim.\n(2) At the time of acknowledgment under paragraph (a) or (b) of subsection (1) of this\nsection, an insurer, its agent, or designee, shall notify the provider, its billing agent,\nor designee that submitted the claim, in writing or electronically, of all information\nthat is missing from the billing instrument, any errors in the billing instrument, or of\nany other circumstances which preclude it from being a clean claim.\n(3) When an insurer, it s agent, or designee has notified a provider, its billing agent, or\ndesignee that submitted the claim, that a claim contains errors, upon receipt of a\ncorrected clean claim the insurer shall adjudicate the corrected clean claim within\nthe applicable claims  payment time frame for a clean claim established in KRS\n304.17A-702.\n(4) By January 1, 2001, an insurer shall have in place a mechanism to inform providers\nof the status of a claim either through:\n(a) Notation on the remittance; or\n(b) By allowing provide rs to check claim status electronically at any time\nfollowing submission of the claim to the insurer.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29330","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:48Z","sha256":"dd11aa309f31145a0a6e8ce89a80f2feb43db7f0aa29cd70b006804173988163","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-702","next":"us-ky/krs-304.17a-705"},"notice":"GroundRules: Original legal text.
