{"data":{"id":"us-ky/krs-304.17a-722","jurisdiction":"us-ky","citation":"KRS 304.17A-722","heading":"Administrative regulations on claims payment practices.","body":"(1) No later than ninety (90) days following July 15, 2002, the department shall\npromulgate administrative regulations requiring all insurers to report information on\na calendar quarter basis on prompt payment of claims to providers, as defined in\nKRS 304.17A-700, that shall be limited to the following:\n(a) The number of clean claims received by the insurer, its agent, or designee\nduring the reporting period;\n(b) The percentage of clean claims received by the insurer, its agent, or designee\nthat were:\n1. Adjudicated within the claims payment timeframe;\n2. Adjudicated within one (1) to thirty (30) days from the end of the claims\npayment timeframe;\n3. Adjudicated within thirty-one (31) to sixty (60) days from the end of the\nclaims payment timeframe;\n4. Adjudicated within sixty-one (61) to ninety (90) days from the end of the\nclaims payment timeframe;\n5. Adjudicated more than ninety (90) days from the end of the claims\npayment timeframe; and\n6. Not yet adjudicated;\n(c) The percentage of clean claims received during the reporting quarter that were\npaid and not denied or contested:\n1. Within the claims payment timeframe;\n2. Within one (1) to thirty (30) days from the end of the claims payment\ntimeframe;\n3. Within thirty -one (31) to sixty (60) days from the end of the claims\npayment timeframe;\n4. Within sixty (60) to ninety (90) days from the end of the claims payment\ntimeframe;\n5. More than ninety (90) days from the end of the claims payment\ntimeframe; and\n6. Not yet paid;\n(d) Amount of interest paid; and\n(e) For clean claims received during the reporting quarter that were not denied or\ncontested, the percentage of the total dollar amount of those claims that were\npaid within the claims payment timeframe.\n(2) Data required in subsection (1) of this section shall be reported for hospitals,\nphysicians, and all other providers, excluding pharmacies.\n(3) Insurers shall submit information required in subsection (1) of this section to the\ndepartment no later than on e hundred eighty (180) days following the close of the\nreporting quarter.\n(4) The department shall, as part of the market conduct survey of each insurer, audit the\ninsurer to determine compliance with KRS 304.17A -700 to 304.17A-730 and KRS\n304.14-135 and 3 04.99-123. Findings shall be made available to the public upon\nrequest.\n(5) The commissioner shall annually present to the Interim Joint Committee on\nBanking and Insurance and to the Governor a report on the payment practices of\ninsurers and compliance wit h the provisions of KRS 304.17A -700 to 304.17A -730\nand KRS 205.593, 304.14 -135, and 304.99 -123 and the commissioner's\nenforcement activities, including the number of complaints received and those acted\nupon by the department.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29340","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:48Z","sha256":"c7be72852143eff5f15c2770e49262cc86be42f40651829c37554eadd697f57b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-720","next":"us-ky/krs-304.17a-724"},"notice":"GroundRules: Original legal text.
