{"data":{"id":"us-ky/krs-304.17a-728","jurisdiction":"us-ky","citation":"KRS 304.17A-728","heading":"Contract disclosures of discounted fees -- Violation is unfair claims","body":"settlement practice.\n(1) A provision identifying the products and markets applicable to any discount as\nprovided in the contract shall be required of all contracts with a:\n(a) Provider or an organization of providers; or\n(b) Preferred provider organization that has a network of preferred providers and\nthe organization has contracted with the health care preferred provider.\n(2) An insurer or entity shall not reimburse on a discoun ted fee basis unless the\ndisclosure is provided in the contract with:\n(a) A provider or organization of providers; or\n(b) An organization that has a network of preferred providers and the insurance\nentity has the written consent of the health care preferred providers.\n(3) An insurer or entity under contract with the insurer who violates this section\ncommits an unfair claims settlement practice violation under Subtitle 12 of KRS\nChapter 304, and is also subject to administrative penalties under Subtitle 99 o f\nKRS Chapter 304.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29343","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:48Z","sha256":"c576533b9c17da72bea53b24a49a788bb1bf109db60f9172c060fc242a231ca5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-726","next":"us-ky/krs-304.17a-730"},"notice":"GroundRules: Original legal text.
