{"data":{"id":"us-ky/krs-304.17a-730","jurisdiction":"us-ky","citation":"KRS 304.17A-730","heading":"Payment of interest for failing to pay, denying, or settling a clean","body":"claim as required.\n(1) An insurer that fails to pay, deny, or settle a clean claim in accordance with KRS\n304.17A-700 to 304.17A-730 and KRS 205.593, 304.14 -135, and 304.99-123 shall\npay interest according to the following schedule on the amount of the claim that\nremains unpaid:\n(a) For claims that are paid between one (1) and thirty (30) days from the date\nthat payment was due under KRS 304.17A -702, interest at a rate of twelve\npercent (12%) per annum shall accrue from the date payment was due under\nKRS 304.17A-702;\n(b) For claims that are paid between thirty -one (31) and sixty (60) days from the\ndate that payment was due under KRS 304.17A -702, interest at a rate of\neighteen percent (18%) per annum shall accrue from the date payment was\ndue under KRS 304.17A-702; and\n(c) For claims that are paid more than sixty (60) days from the date payment was\ndue under KRS 304.17A -702, interest at a rate of twenty -one percent (21%)\nper annum sh all accrue from the date that payment was due under KRS\n304.17A-702.\n(2) When paying a claim after the time required by KRS 304.17A-702, the insurer shall\nadd the interest payable to the amount of the unpaid claim without the necessity for\nany claim for th at interest to be made by the provider filing the original claim. The\ninterest obligation otherwise imposed by this section shall not apply if the failure to\npay, deny, or settle a claim is due to, or results from, in whole or in part, acts or\nevents beyond the control of the insurer, including but not limited to acts of God,\nnatural disasters, epidemics, strikes or other labor disruptions, war, civil\ndisturbance, riot, or complete or partial disruptions of facilities.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29344","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:48Z","sha256":"8448ee56a1fe6a3d2030e6145616f79dc18516ae546aa5ca56fd9d25c067b043","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-728","next":"us-ky/krs-304.17a-732"},"notice":"GroundRules: Original legal text.
