{"data":{"id":"us-ky/krs-304.17a-760","jurisdiction":"us-ky","citation":"KRS 304.17A-760","heading":"Duties and powers of insurance purchasing outlet.","body":"(1) An insurance purchasing outlet shall:\n(a) Set and collect fees to finance necessary costs incurred in marketing, selling,\nservicing, and administering its services;\n(b) Offer health benefit plans to eligible persons;\n(c) Provide premium and voucher collection services for participating insurers;\n(d) Establish and adhere to appropriate administrative and accounting procedures\nfor operating the health purchasing outlet;\n(e) Establish and adhere to rules, conditions, and procedures for insurance\npurchasing outlet members and participating insurers;\n(f) Establish and adhere to enrollment and participation requirements for\ninsurance purchasing outlet members;\n(g) Receive, review, and conduct appeals for persons who have been denied\nenrollment to an insurance purchasing outlet;\n(h) Demonstrate and maintain at all times proof of financial responsibility and\nsolvency;\n(i) Prepare an annual report on the operations of the insurance purchasing outlet\nin accordance with administrative regulations promulgated by the\ncommissioner;\n(j) Establish procedures for billing and collection of premiums from insurance\npurchasing outlet members;\n(k) Establish procedures for collecting and redeeming vouchers; and\n(l) Maintain an administrator license in accordance with Subtitle 9 of C hapter\n304.\n(2) An insurance purchasing outlet may:\n(a) Contract with qualified third parties for any services necessary to carry out the\npowers and duties authorized or required by this chapter;\n(b) Employ necessary staff;\n(c) Sue or be sued;\n(d) Contract with independent licensed administrators to adjust or settle claims,\nsince the insurance purchasing outlet is prohibited from these activities in\naccordance with KRS 304.17A-758; and\n(e) Employ, contract, or otherwise use licensed insurance agents  to market and\nservice coverage.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29355","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:48Z","sha256":"64e557fa91c6ae83d8a4cd83133f662a61a9a4e4a86807987d5a984c023a76ce","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-758","next":"us-ky/krs-304.17a-762"},"notice":"GroundRules: Original legal text.
