{"data":{"id":"us-ky/krs-304.17a-802","jurisdiction":"us-ky","citation":"KRS 304.17A-802","heading":"Definitions for KRS 304.17A-800 to 304.17A-844.","body":"(1) \"Administrator\" means an individual, partnership, corporation, association, or other\nlegal entity engaged by a self-insured employer-organized association group's board\nof trustees to carry out the policies established by the group's board of trustees and\nto provide day-to-day management of the group.\n(2) \"Agent\" means any person directly or indirectly associated with such organization\nwho engages in solicitation or enrollment of persons for profit or pecuniary gain in a\nself-insured employer-organized association group.\n(3) \"Commissioner\" means the commissioner of the Department of Insurance.\n(4) \"Deceptive\" means an act, practice, or statement which has the tendency or capacity\nto deceive, without regard to whether there is an intent to deceive or whether any\nperson has suffered loss or injury as a result of the act, practice, or statement.\n(5) \"Employer-organized association\" means an entity defined in KRS 304.17A-804.\n(6) \"Governmental entity\" means the Commonwealth of Kentucky, other states, or the\nUnited States, their political subdivisions, municipal corporations, or public\nagencies.\n(7) \"Insolvent\" or \"insolvency\" means the inability of a self -insured employer -\norganized association group to pay its outstanding lawful obligations as they mature\nin the r egular course of business, as may be shown either by an excess of its\nrequired reserves and other liabilities over its assets or by its not having sufficient\nassets to reinsure all of its outstanding liabilities after paying all accrued claims\nowed by it.\n(8) \"Person\" includes but is not limited to any individual, partnership, association, trust,\nor corporation.\n(9) \"Qualified actuary\" means a member of the American Academy of Actuaries or a\nFellow of the Society of Actuaries.\n(10) \"Self-insured employer -organized association group\" means a group described in\nKRS 304.17A-804.\n(11) \"Service company\" means a person or entity which provides services not provided\nby the administrator, including but not limited to claims adjustment, compilation of\nstatistics in p reparation of contribution and assessments, loss, and tax reports,\npreparation of other required self -insurance reports, development of members'\ncontributions, assessments, and fees, and administration of a claim fund.\n(12) \"Unfair\" means an act, practice, or statement which is unconscionable.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29362","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:48Z","sha256":"5016044861edbf6ba55920a5495161ec3321ec64354807476ed24be353cad6f7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-800","next":"us-ky/krs-304.17a-804"},"notice":"GroundRules: Original legal text.
