{"data":{"id":"us-ky/krs-304.17a-810","jurisdiction":"us-ky","citation":"KRS 304.17A-810","heading":"Conditions for issuance of certificate of filing.","body":"Upon receipt of an application for a certificate of filing, the commissioner shall issue or\ndeny the same. A certificate of filing shall be issued only if the commissioner finds that\nthe applicant has complied with KRS 304.17A -808, has paid the application  fee, and the\ncommissioner is satisfied that the following conditions are met:\n(1) The persons responsible for the conduct of the affairs of the self -insured employer-\norganized association group are competent, trustworthy, and possess good\nreputation; and\n(2) The self -insured employer -organized association group is financially responsible\nand may reasonably be expected to meet its obligations to participants and\nprospective participants. In making this determination, the commissioner may\nconsider:\n(a) The adequacy of working capital;\n(b) Any agreement with an insurer, a government, or any other organization for\ninsuring the payment of health claims or the provision for automatic\napplicability of an alternative coverage in the event of discontinuance of the\nself-insurance group; and\n(c) Compliance with KRS 304.17A -812, as a guarantee that the obligations will\nbe duly performed.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29366","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:48Z","sha256":"2f5279c4cb425c6cd4394c2c61230f953f707a7a1e34d0d7ba28bd15a043eb25","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-808","next":"us-ky/krs-304.17a-812"},"notice":"GroundRules: Original legal text.
