{"data":{"id":"us-ky/krs-304.17a-828","jurisdiction":"us-ky","citation":"KRS 304.17A-828","heading":"Membership -- Liability on termination of membership, insolvency, or","body":"bankruptcy.\n(1) An employer joining a self -insured employer-organized association group after the\ngroup has been issued a certificate of filing shall submit an application for\nmembership to the board of trustees or its administrator. Membership shall take\neffect no earlier than each member's date of application. The application for\nmembership and its approval shall be maintained as permanent records of the board\nof trustees.\n(2) Individual members of a self-insured employer-organized association group shall be\nsubject to cancellation by the group pursuant to the governance documents of the\ngroup. In addition, individual group members may elect to terminate their\nparticipation in the group.\n(3) A self-insured employer-organized association shall pay all health liabilities which\nare covered under the terms, conditions, and exclusions of the group's evidence of\ncoverage which each member elects during its period of membership. A member\nwho elects to terminate its membership or is canceled by a group remains liable for\ncontribution obligations which were incurred during the canceled or terminated\ngroup members' period of membership. A group member is not relieved of its health\nliabilities incurred during its period of membership in a self -insured employer -\norganized association group except through payment of its contribution obligations\nto the group.\n(4) The insolvency or bankruptcy of a group member does not relieve the self -insured\nemployer-organized association group of liability for the payment of health\nliabilities which are covered under the terms, conditions, and exclusions of the\ngroup's evidence of coverage and incurred during the insolvent or bankrupt group\nmember's period of membership.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29375","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:48Z","sha256":"94435df7e23730ac9bb081692fab516b7e8ce9ce4856740565961bda9c353335","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-826","next":"us-ky/krs-304.17a-830"},"notice":"GroundRules: Original legal text.
