{"data":{"id":"us-ky/krs-304.17a-840","jurisdiction":"us-ky","citation":"KRS 304.17A-840","heading":"Suspension or revocation of certificate of filing.","body":"(1) The commissioner may suspend or revoke any certificate of filing issued to a self -\ninsured employer-organized association group if the commissioner finds that any of\nthe following conditions exist:\n(a) The self -insured employer -organized association group i s operating\nsignificantly in contravention of its basic organizational document or in a\nmanner contrary to that described in and reasonably inferred from any other\ninformation submitted under KRS 304.17A -800 to 304.17A -844, unless\namendments to the submiss ions have been filed with and approved by the\ncommissioner;\n(b) The self -insured employer -organized association group is no longer\nfinancially responsible and may reasonably be expected to be unable to meet\nits obligations to participants or prospective participants;\n(c) The self -insured employer-organized association group, or any person at its\ndirection, has advertised or merchandised its services in an untrue,\nmisrepresentative, misleading, deceptive, or unfair manner;\n(d) The self -insured employer -organized association group has engaged in any\nunfair or deceptive practices under its certificate of filing; or\n(e) The self-insured employer-organized association group has failed to correct a\nviolation of KRS 304.17A -800 to 304.17A -844 or the administrative\nregulations promulgated thereunder, within a reasonable time period\nestablished by the commissioner in administrative regulations.\n(2) A certificate of filing shall be suspended or revoked only after compliance with the\nhearing procedure set forth in KRS 304.2-310 to 304.2-370.\n(3) When a certificate of filing of a self -insured employer-organized association group\nis suspended, the group shall not, during the period of suspension, enroll any new\nparticipants and shall not engage in any advertising or solicitation.\n(4) If the certificate of filing of a self -insured employer-organized association group is\nrevoked, the group shall proceed, immediately following the effective date of the\norder of revocation, to wind up its affairs and shall conduct no further bu siness,\nexcept as may be essential to the orderly conclusion of the affairs of the\norganization. It shall engage in no further advertising or solicitation. The\ncommissioner may, by written order, prevent further operation of the group if he or\nshe finds it  to be in the best interest of the participants, to the end that the\nparticipants will be afforded the greatest practical opportunity to obtain health\ncoverage elsewhere. If the commissioner permits further operation, the self -insured\nemployer-organized as sociation group shall continue to collect the contributions\nrequired of participants.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29381","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:48Z","sha256":"73454db661f734aca5e5ffbce97a210f55ddcb210d467544bdb801fa46100266","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-838","next":"us-ky/krs-304.17a-842"},"notice":"GroundRules: Original legal text.
