{"data":{"id":"us-ky/krs-304.17a-844","jurisdiction":"us-ky","citation":"KRS 304.17A-844","heading":"Prohibited activities -- Penalties.","body":"(1) After a hearing or upon agreement by the self -insured employer -organized\nassociation group, the commissioner may suspend or revoke the certificate of filing\nof a self-insured employer-organized association group, impose a civil penalty of up\nto five thousand dollars ($5,000) per violation on a self-insured employer-organized\nassociation group, or both, for:\n(a) Violations of KRS 304.12 -237, 304.17A -800 to 304.17A -844, or\nadministrative regulations promulgated thereunder;\n(b) Obtaining a certificate of filing by unfair or deceptive means;\n(c) Operating in a financially hazardous manner;\n(d) Misappropriation, conversion, illegal withholding, or refusal to pay over upon\nproper demand any moneys that belong to a member, an employee of a\nmember, or a person other wise entitled thereto by the group or its\nadministrator; or\n(e) Unfair or deceptive business practices.\n(2) The commissioner, in his or her discretion and without advance notice or a hearing\nthereon, may suspend or revoke the certificate of filing of any s elf-insured\nemployer-organized association group upon the commencement of the following\nproceedings:\n(a) Receivership;\n(b) Conservatorship;\n(c) Rehabilitation; or\n(d) Other delinquency proceedings.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50953","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:48Z","sha256":"ad7a39214b71f97c38287cf910c27d1cce5ee1db3441d0a3024a79892e5a59c8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-842","next":"us-ky/krs-304.17a-846"},"notice":"GroundRules: Original legal text.
