{"data":{"id":"us-ky/krs-304.17b-023","jurisdiction":"us-ky","citation":"KRS 304.17B-023","heading":"Duties of GAP participating insurer and department to report and to","body":"provide information -- Payment of GAP losses -- Examination of insurers to\ndetermine accuracy of information provided.\n(1) After the end of each calendar year, a GAP partic ipating insurer shall report the\nfollowing information for the previous calendar year:\n(a) The total earned premium in the individual, small group, large group, and\nassociation markets;\n(b) The number of GAP policies in force as of December 31;\n(c) The amount of the insurer's GAP premiums received during the calendar year\ncovered by the report;\n(d) The amount of the insurer's GAP claims paid during the calendar year covered\nby the report;\n(e) The amount of the insurer's GAP losses; and\n(f) Other information as the office may require to be reported.\n(2) After the end of each calendar year, and based upon the reports filed under\nsubsection (1) of this section, the office shall calculate and provide to each insurer\nwho filed a report the following information relating to the calendar year:\n(a) The amount of each reporting insurer's market share;\n(b) The total amount of GAP premiums for all reporting insurers;\n(c) The total amount of GAP claims paid by all reporting insurers;\n(d) The amount of total actual GAP losses;\n(e) The amount of the insurer's assessment or refund; and\n(f) Other information as the office may elect to calculate and report.\nThe office shall complete its calculation and provide each insurer the results of its\ncalculation within sixty (60) days after receiving all required information.\n(3) The office shall pay GAP losses to GAP participating insurers in accordance with\nthis section and KRS 304.17B-021(5).\n(4) The office shall conduct examinations of insurers part icipating in Kentucky Access\nas are reasonably necessary to determine if the information provided by the insurers\nis accurate.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48822","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:48Z","sha256":"db536894b4529c81449496b505be4e9378e5846402272af31b4d58fb90b0ad32","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17b-021","next":"us-ky/krs-304.17b-025"},"notice":"GroundRules: Original legal text.
