{"data":{"id":"us-ky/krs-304.17c-070","jurisdiction":"us-ky","citation":"KRS 304.17C-070","heading":"Prohibition of contract to limit disclosure to enrollee -- Actions for","body":"which provider may not be penalized -- Disclosure of arrangements between\nplan and providers.\n(1) An insurer may not contract with a health care provider to limit the provider' s\ndisclosure to an enrollee, or to another person on behalf of an enrollee, of any\ninformation relating to the enrollee's medical condition or treatment option.\n(2) A health care provider shall not be penalized, or a health care provider's contract\nwith a limited health service benefit plan terminated, because the provider discusses\nmedically necessary or appropriate care with an enrollee or another person on behalf\nof an enrollee.\n(a) The health care provider may not be prohibited by the plan from discussing all\ntreatment options with the enrollee.\n(b) Other information determined by the health care provider to be in the best\ninterests of the enrollee may be disclosed by the provider to the enrollee or to\nanother person on behalf of an enrollee.\n(3) (a) A h ealth care provider shall not be penalized for discussing financial\nincentives and financial arrangements between the provider and the insurer\nwith an enrollee.\n(b) Upon request, an insurer shall inform its enrollees in writing of the type of\nfinancial arrangements between the plan and participating providers if those\narrangements include an incentive or bonus.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29410","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:49Z","sha256":"eb98550cfa4de7cb1800b2b1cd123404dcaaacdcd23ad11c560cab4af137cb96","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17c-060","next":"us-ky/krs-304.17c-080"},"notice":"GroundRules: Original legal text.
