{"data":{"id":"us-ky/krs-304.17c-136","jurisdiction":"us-ky","citation":"KRS 304.17C-136","heading":"Definitions for section -- Prohibition against payment method","body":"restrictions for dental benefit plan -- Electronic fund transfer payments.\n(1) As used in this section:\n(a) \"Credit card payment\":\n1. Means a type of electronic funds transfer in which a dental benefit plan\nor its contracted vendor issues a single -use series of numbers associated\nwith the payment of dental services:\na. Performed by a dentist and chargeable to a predetermined dollar\namount; and\nb. For which the dentist is respons ible for processing the payment by\na credit card terminal or Internet portal; and\n2. Shall include virtual or online credit card payments for which no\nphysical credit card is presented to the dentist and the single -use credit\ncard expires upon payment processing;\n(b) \"Dentist agent\" means a person that establishes an agency relationship\ncontract with a dentist to process bills for services provided by the dentist\nunder terms and conditions established between the agent and dentist. Such\ncontracts may permit the dentist agent to submit bills, request reconsideration,\nand receive reimbursement; and\n(c) \"Electronic funds transfer payment\":\n1. Means a payment by any method of electronic funds transfer other than\nhealth care electronic fund transfer and remittanc e advice transactions\nunder 45 C.F.R. secs. 162.1601 and 162.1602; and\n2. Shall include virtual credit card payments.\n(2) A dental benefit plan shall not contain restrictions on methods of payment from the\ndental benefit plan or its vendors to the dentist in which the only acceptable\npayment method is a credit card payment.\n(3) When initiating or changing payments to a dentist using electronic funds transfer\npayments, a dental benefit plan or its vendors shall:\n(a) Notify the dentist if any fees are associated with a particular payment method;\n(b) Advise the dentist of the available methods of payment; and\n(c) Provide clear instructions to the dentist as to how to select an alternative\npayment method.\n(4) (a) A denta l benefit plan or its vendor that initiates or changes payments to a\ndentist for health care electronic fund transfer and remittance advice\ntransactions under 45 C.F.R. secs. 162.1601 and 162.1602 shall not charge a\nfee solely to transmit the payment to th e dentist unless the dentist has\nconsented to the fee.\n(b) When transmitting health care electronic fund transfer and remittance advice\ntransactions under 45 C.F.R. secs. 162.1601 and 162.1602, a dentist agent\nmay charge reasonable fees for payments relate d to transaction management,\ndata management, portal services, and other value -added services in addition\nto the bank transmittal.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52591","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:49Z","sha256":"04cc3a78b96eff37c0cfec4c49f9670890f43a592964d1d40041cf49089ae43e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17c-134","next":"us-ky/krs-304.17c-137"},"notice":"GroundRules: Original legal text.
