{"data":{"id":"us-ky/krs-304.18-037","jurisdiction":"us-ky","citation":"KRS 304.18-037","heading":"Group  or blanket health insurers to offer home  health care","body":"coverage to master policyholder -- Conditions.\n(1) All insurers issuing group or blanket health insurance policies and certificates\nissued thereunder in the Commonwealth  providing coverage on an expense\nincurred basis shall make  available and offer to the master policyholder\ncoverage for home  health care. The coverage may contain a limitation on the\nnumber  of home  health care visits for which benefits are payable, but the\nnumber  of such visits shall not be less than sixty (60) in any calendar year or in\nany continuous period of twelve (12) months for each person covered under\nthe policy. Each visit by an authorized representative of a home health agency\nshall be considered as one (1) home health care visit except that at least four\n(4) hours of home  health aide service shall be considered as one (1) home\nhealth visit.\n(2) Home  health care coverage shall be subject to the same  deductible and\ncoinsurance provisions as are other services covered by insurers issuing group\nor blanket health insurance policies in the Commonwealth.\n(3) Home  health care shall not be reimbursed unless an attending physician, an\nadvanced  practice registered nurse, or a physician assistant certifies that\nhospitalization or confinement in a skilled nursing facility as defined by the\nKentucky  Health Facilities and  Health Services Certificate of Need  and\nLicensure Board would otherwise be required if home  health care was not\nprovided.\n(4) Medicare beneficiaries shall be deemed  eligible to receive home  health care\nbenefits under a group or blanket health insurance policy provided that the\npolicy shall only pay for those home health care services which are not paid for\nby Medicare and do not exceed the maximum  liability of the policy.\n(5) Pursuant to the provisions of this section, all insurers issuing group or blanket\nhealth  insurance policies and  certificates issued  thereunder in  the\nCommonwealth  providing coverage on an expense  incurred basis which\ninclude coverage for home  health care shall inform the beneficiaries of such\npolicies, in writing, of the specific home health care benefits which are covered.\nSuch  written notification shall take place at the time of issuance or reissuance\nof the policy.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50733","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:49Z","sha256":"aaf4ce85f279737fadf136bef0876249040b763c150c7d47b155fff26f885b15","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.18-0365","next":"us-ky/krs-304.18-038"},"notice":"GroundRules: Original legal text.
