{"data":{"id":"us-ky/krs-304.18-090","jurisdiction":"us-ky","citation":"KRS 304.18-090","heading":"Payment of benefits under blanket health insurance policy or contract.","body":"Except as provided in KRS 304.17A-265 and 304.17C-137:\n(1) Subject to subsection (2) of this section, all benefits under any blanket health\ninsurance policy or co ntract shall be payable to the person insured, or to the\nperson's designated beneficiary or beneficiaries, or to the person's estate, except that\nif the person insured is a minor or otherwise not competent to give a valid release,\nthe benefits may be made payable to the person's parent, guardian, conservator, or\nother person actually supporting the minor or person not competent to give a valid\nrelease; and\n(2) (a) A blanket health insurance policy or contract may provide that all or a portion\nof any indemni ties provided by the policy or contract on account of hospital,\nnursing, medical, or surgical services may, at the option of the insurer and\nunless the insured requests otherwise in writing not later than the time of\nfiling proofs of such loss, be paid dir ectly to the hospital or person rendering\nsuch services, but the policy or contract may not require that the service be\nrendered by a particular hospital or person.\n(b) Payment made directly to a hospital or other person for all or a portion of any\nindemnities provided by a blanket health insurance policy or contract shall\ndischarge the obligation of the insurer with respect to the amount of insurance\nso paid.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56664","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:49Z","sha256":"94884264bc2083798c0ede948c27c4d5925e2a135e74dc01650dda6d66b3d67d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.18-085","next":"us-ky/krs-304.18-095"},"notice":"GroundRules: Original legal text.
