{"data":{"id":"us-ky/krs-304.18-126","jurisdiction":"us-ky","citation":"KRS 304.18-126","heading":"Policies to provide reasonable extension of benefits during disability --","body":"Extensions to be described in group policies and certificates.\n(1) As used in this section, \"disability\" means the state of being hospitalized on the date\nof replacement coverage or coverage under an extension of benefits provision.\n(2) An insurer offering group health insurance, as defined in KRS 304.18 -020, shall\nprovide for an extension of benefits in the event of a member's total disability at the\ndate of discontinuance of  the group policy or contract in accordance with this\nsection.\n(3) Benefits payable under an extension of benefits shall be limited to the member's\nhospital confinement or period of total disability for a specific condition, injury, or\nillness that resulted in the member's total disability.\n(4) In the case of hospital or medical expense coverages, a reasonable extension of\nbenefits or accrued liability shall be required. A provision shall be considered\nreasonable if:\n(a) Under major medical coverages for ho spital confinement, it provides an\nextension until the earlier of one (1) of the following:\n1. Discharge from the hospital confinement;\n2. Until maximum benefits under the policy are received; or\n3. At least twelve (12) months.\n(b) Under major medical cove rage for a period of total disability, it provides an\nextension of benefits until the earlier of one (1) of the following:\n1. Until coverage for the total disability has been obtained under another\ngroup policy;\n2. Until the total disability ceases;\n3. Until maximum benefits under the policy are received; or\n4. At least twelve (12) months.\n(c) Under other types of hospital or medical expense coverages, it provides an\nextension of at least ninety (90) days for expenses incurred during the period\nof total disability or hospital confinement or incurred within a period of at\nleast ninety (90) days starting with a specific event which occurred while\ncoverage was in force, such as an accident.\n(5) Coverage for a total disability shall not be considered to have been obtained under a\nsucceeding plan, whether it be fully insured or self -insured, if the succeeding plan\nexcludes coverage for the total disability covered under the prior plan's extension of\nbenefits provision.\n(6) Any applicable extension of benefits or accrued liability shall be described in the\ngroup policy as well as in group insurance certificates.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29450","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:49Z","sha256":"b116e4e67f2f25caa287b8c4cc9008b3af4ca8a0af207e34fa95f332dce34215","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.18-125","next":"us-ky/krs-304.18-127"},"notice":"GroundRules: Original legal text.
