{"data":{"id":"us-ky/krs-304.18-130","jurisdiction":"us-ky","citation":"KRS 304.18-130","heading":"Policies to cover treatment for alcoholism -- Exclusions.","body":"(1) Except as otherwise expressly provided herein, no contract providing major medical\nor outpatient care benefits, issued pursuant to Subtitles 18, 32, and 38 of KRS\nChapter 304, shall be sold or offered for sale in the Commonwealth of Kentucky\nunless such co ntract offers the master policyholder the option to purchase in new\ncontracts the minimum benefits for treatment of alcoholism as specified in KRS\n304.18-140.\n(2) Coverage for treatment shall be divided into three (3) distinct phases:\n(a) Emergency detoxification treatment;\n(b) Residential treatment; and\n(c) Outpatient treatment.\nSuch contracts shall contain a stipulation that no payment shall be made by the\ncarrier to the provider except upon completion of the phase of program of treatment\nby the patient,  under the guidance and direction of a physician licensed to practice\nin the Commonwealth or a professional, designated by such physician, who is a\nrecognized staff member of a treatment facility licensed by the department or\naccredited by the Joint Commission.\n(3) Disability and accident income benefits and basic health care contracts that do not\nprovide major medical or outpatient care are excluded from KRS 304.18 -130 to\n304.18-180.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44050","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:49Z","sha256":"c305f4d00fe6f33f2b5a7763c0841303fe5b0af4f49384177d6dff25d356f802","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.18-127","next":"us-ky/krs-304.18-140"},"notice":"GroundRules: Original legal text.
