{"data":{"id":"us-ky/krs-304.2-150","jurisdiction":"us-ky","citation":"KRS 304.2-150","heading":"Records -- Inspection -- Destruction -- Subject to Open Records Act.","body":"(1) The commissioner shall carefully preserve in the department and in permanent\nform, a correct account of all his or her transactions and of all fees and moneys\nreceived by him or her by virtue of his or her office, together with all financial\nstatements, ex amination reports, correspondence, filings, and documents duly\nreceived by the department. The commissioner shall hand the same over to his or\nher successor in office.\n(2) The commissioner shall keep a suitable record of all insurer certificates of authori ty\nand of all licenses issued under this code, together with all applicable suspensions\nand revocations and of the causes thereof.\n(3) Unless otherwise provided by law, records of the department shall be open to the\nextent provided by the Kentucky Open Records Act, KRS 61.872 to 61.884:\n(a) The following records shall be open:\n1. Rate and form filings and information filed in support thereof;\n2. Other records as provided by law; and\n3. All information filed by the department with the National Association of\nInsurance Commissioners, which that association makes available;\n(b) The following records shall be closed:\n1. All information received in confidence from insurance supervisory\nofficials of other states or countries, or the National Association of\nInsurance Commissioners, including, but not limited to, information\nfrom the insurance regulatory information system. However, records\ndescribed in this paragraph may be used by the commissioner in\nenforcement prosecutions and proceedings for disciplinary action,  and\nmay be disclosed to other law enforcement authorities; and\n2. Other records as provided by law; and\n(c) When inspection of department records is denied, any person challenging the\ndenial shall follow the procedures set forth in the Kentucky Open Recor ds\nAct, KRS 61.872 to 61.884.\n(4) After five (5) years, the commissioner may destroy unneeded or obsolete records\nand filings in the department.\n(5) The department shall not charge a fee inconsistent with fees charged by other state\nagencies for copies of records requested by the public pursuant to this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16662","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:36Z","sha256":"6dc2dc284a653e9904c3e7c62ea467241c263d9aa89346bd0d2919f67875de61","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.2-140","next":"us-ky/krs-304.2-155"},"notice":"GroundRules: Original legal text.
