{"data":{"id":"us-ky/krs-304.2-205","jurisdiction":"us-ky","citation":"KRS 304.2-205","heading":"Annual statement convention blank -- Immunity from prosecution.","body":"(1) The provisions of this section apply to all domestic, foreign, and alien insurers,\nfraternal benefit societies, health maintenance organizations, and nonprofit hospital,\nmedical-surgical, dental, and health service corporations authorized to transact\nbusiness pursuant to this chapter.\n(2) (a) 1. Each domestic, foreign, and alien insurer, fraternal benefit society,\nhealth maintenance organization, and nonprofit hospital, medical -\nsurgical, dental, and health service corporation authorized to transact\nbusiness pursuant to this chapter shall annually on or before March 1 of\neach year file with the National Association of Insurance Commissioners\na copy of its annual statement convention blank, along with additional\nfilings as prescribed by the commissioner, for the preceding year.\n2. The information filed with the National Association of Insurance\nCommissioners shall:\na. Be submitted electronically;\nb. Be in the same format and scope as that required by the\ncommissioner; and\nc. Include the:\ni. Signed jurat page; and\nii. Life and health actuarial certification.\n3. Any amendments or additions to the annual statement filing\nsubsequently filed with the commissioner shall also be filed\nelectronically with the National Association of Insurance\nCommissioners.\n(b) Foreign insurers, health maintenance organizations, and fraternal benefit\nsocieties that are domiciled in states which have laws substantially similar to\nparagraph (a) of this subsection shall be deemed in compliance with this\nsection.\n(c) Nothing contained in this section shall be deemed to require anyone filing\ndocuments with the National Association of Insurance Commissioners to pay\nany filing fee for a filing.\n(3) Members of the National Association of Insurance Commissioners, their duly\nauthorized committees, subcommittees, and task forces, their delegates, National\nAssociation of Insurance Commissioners employees, and all others charged with the\nresponsibility of collecting, reviewing, analyzing, or disseminating the information\ndeveloped from the filing of the annual statement convention blanks shall not be\nsubject to civil liability for defamation or any other cause of action by virtue of their\ncollection, review, analysis, or dissemination of the data and information collected\nfrom the filings required by this section while acting in good faith.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52896","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:37Z","sha256":"9cb550e0e60c5207e9972f7b99838f2b30aa60d167d40862b599faf205cfa942","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.2-200","next":"us-ky/krs-304.2-210"},"notice":"GroundRules: Original legal text.
