{"data":{"id":"us-ky/krs-304.2-250","jurisdiction":"us-ky","citation":"KRS 304.2-250","heading":"Examination reports -- Contents -- Prima facie evidence in certain","body":"proceedings -- Confidentiality.\n(1) Upon completion of an examination, the examiner in charge shall make a true report\nthereof which shall comprise only facts appearing upon the book s, records or other\ndocuments of the person examined, or as ascertained from the sworn testimony of\nits officers or agents or other individuals examined concerning its affairs, and such\nconclusions and recommendations as may reasonably be warranted from such facts.\n(2) The report of examination of an insurer shall be prima facie evidence in any action\nor proceeding for the receivership, conservation or liquidation of the insurer brought\nin the name of the state against the insurer, its officers or agents up on the facts\nstated therein, and whether or not the report has then been filed in the department as\nprovided in KRS 304.2-260.\n(3) Except as provided in KRS 304.2 -260 and 304.2 -270, documents, materials, or\nother information, including examination workpape rs, in the possession or control\nof the commissioner that are created, produced, or obtained by or disclosed to the\ncommissioner or any other person in the course of an examination made under this\nsubtitle, or in the course of an examination made under KRS  304.2-210 to 304.2 -\n300, or in the course of analysis by the commissioner of the financial condition, or\nmarket conduct of an insurer shall be confidential by law and privileged but may be\nused, received, and shared in accordance with KRS 304.2-210.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16676","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:37Z","sha256":"ec59f18abb21ddb3169eb0fffe97485982cff3bb6b31ec7fcc0d946171a48bff","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.2-240","next":"us-ky/krs-304.2-260"},"notice":"GroundRules: Original legal text.
