{"data":{"id":"us-ky/krs-304.2-310","jurisdiction":"us-ky","citation":"KRS 304.2-310","heading":"Administrative procedures -- Hearings.","body":"(1) The commissioner may hold a hearing, without request by others, for any purpose\nwithin the scope of this code.\n(2) The commissioner shall hold a hearing:\n(a) If required by any other provision of this code; or\n(b) Upon written application for a hearing by a person aggrieved by any act,\nthreatened act, or failure of the commissioner to act, or by any report,\nadministrative regulation, or order of the commissioner (other than an order\nfor the holding of a hearing, or a final order entered after a hearing, of which\nhearing the person had notice). Any application for a hearing shall be filed in\nthe department within sixty (60) days after the person knew or reasonably\nshould have known, of the act, threatened act, failure, report, administrative\nregulation, or or der, unless a different period is provided for by other laws\napplicable to the particular matter, in which case the other law shall govern.\n(3) Any application for a hearing shall briefly state the respects in which the applicant\nis so aggrieved, together with the grounds to be relied upon as a basis for the relief\nto be sought at the hearing.\n(4) If the commissioner finds that the application is made in good faith, that the\napplicant would be so aggrieved if his or her grounds are established, the\ncommissioner shall hold the hearing in accordance with KRS Chapter 13B.\n(5) Pending the hearing and the issuance of the final order resulting from the hearing,\nthe commissioner shall suspend or postpone the effective date of the previous\naction.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16682","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:37Z","sha256":"f5ead7f1a19f7bc782047886c8492b567f85fbbe5da4f4ce1b0c8679cadb6dea","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.2-300","next":"us-ky/krs-304.2-320"},"notice":"GroundRules: Original legal text.
