{"data":{"id":"us-ky/krs-304.2-340","jurisdiction":"us-ky","citation":"KRS 304.2-340","heading":"Witnesses and evidence.","body":"(1) The commissioner or an authorized designee conducting a hearing, examination, or\ninvestigation by his or her authority shall have power to subpoena witnesses,\ncompel their attendance, administer oaths, examine any person under oath relative\nto the subject of the hearing, examination, or investigation, and to compel any\nperson to subscribe to his or her testimony after it has been correctly reduced to\nwriting, and, in connection therewith, to require the production of any books,\npapers, records, corresponden ce, or other documents which the commissioner\ndeems relevant to the inquiry.\n(2) A subpoena issued pursuant to this section shall have the same force and effect as if\nissued from a court of record.\n(3) A subpoena issued pursuant to this section shall be se rved in the same manner as if\nissued from a court of record, except a subpoena may be served upon any person\nholding a license or a certificate of authority from the commissioner or upon the\nemployee of the person or entity in the same manner as other orde rs and notices are\nserved, as provided in KRS 304.2-120.\n(4) If any individual or licensee refuses to comply with a subpoena or to testify as to\nany matter concerning which the individual or licensee may be lawfully\ninterrogated:\n(a) The Circuit Court of t he county wherein the examination, investigation, or\nhearing is being conducted or of the county wherein the individual or licensee\nresides, on the commissioner's application may, after summary hearing, issue\nan order requiring the individual or licensee t o comply with the subpoena and\nto testify; and failure to obey an order may be punished by the court as a\ncontempt thereof; and\n(b) The commissioner may suspend or revoke the certificate of authority or\nlicense of any licensee or impose an administrative f ine, or both, for failure of\nthe licensee or the employee of any licensee to comply.\n(5) Witness fees and mileage, if claimed, shall be allowed the same as for testimony in\na Circuit Court, but no officer, director, agent or employee of an insurer or perso n\nbeing examined or investigated shall be entitled to witness or mileage fees.\n(6) Any individual willfully testifying falsely under oath as to any material to any\nexamination, investigation, or hearing shall upon conviction thereof be guilty of\nperjury.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16685","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:37Z","sha256":"79602d73d03086935f07cf40c0fe403af3c1077bf5e46a46ccde02ab94f1335b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.2-330","next":"us-ky/krs-304.2-350"},"notice":"GroundRules: Original legal text.
