{"data":{"id":"us-ky/krs-304.2-350","jurisdiction":"us-ky","citation":"KRS 304.2-350","heading":"Testimony compelled -- Immunity from prosecution.","body":"(1) If any person asks to be excused from attending or testifying or from producing any\nbooks, papers, records, contracts, documents, or other evidence in connection with\nany examination, hearing, or investigation being conducted by the commissioner,\nhis or her deputy or examiner, or in any proceeding or action before any court upon\na charge of violation of this code, on the ground that the testimony or evidence\nrequired of the person may tend to incriminate the person or subject the person to a\npenalty or forf eiture, and shall notwithstanding be directed to give testimony or\nproduce evidence, the person must, if so directed by the commissioner and the\nAttorney General, nonetheless comply with the direction; but the person shall not\nthereafter be prosecuted or s ubjected to any criminal penalty or forfeiture for or on\naccount of any transaction, matter, or thing concerning which the person may have\nso testified or produced evidence, and no testimony so given or evidence produced\nshall be received against the perso n upon any criminal action, investigation, or\nproceeding; except, however, that no person so testifying shall be exempt from\nprosecution or punishment for any perjury committed by the person in giving\ntestimony, and the testimony or evidence so given or pr oduced shall be admissible\nagainst the person upon any criminal action, investigation, or proceeding concerning\nperjury.\n(2) Any individual may execute, acknowledge, and file in the department a statement\nexpressly waiving immunity or privilege in respect to any transaction, matter, or\nthing specified in a statement, and thereupon the testimony of the individual or the\nevidence in relation to the transaction, matter, or thing may be received or produced\nbefore any judge, court, tribunal, grand jury, or othe rwise, and if so received or\nproduced the individual shall not be entitled to any immunity or privileges on\naccount of any testimony he or she may so give or evidence so produced.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16686","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:37Z","sha256":"b0d8541dae9f5dcb43597eaf4194da535816c9f25c7b5571f50f86815b0853c7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.2-340","next":"us-ky/krs-304.2-360"},"notice":"GroundRules: Original legal text.
