{"data":{"id":"us-ky/krs-304.2-360","jurisdiction":"us-ky","citation":"KRS 304.2-360","heading":"Order on hearing.","body":"(1) In the conduct of hearings under this code and making a final order thereon, the\ncommissioner shall act in a quasijudicial capacity and in accordance with the\nprovisions of this chapter and KRS Chapter 13B.\n(2) With respect to hearings held concerning merg er, consolidation, bulk reinsurance,\nconversion, affiliation, or change of control of a domestic insurer as provided in\nSubtitle 24, or in Subtitle 37 of this chapter, where notice of the hearing was given\nto all stockholders and policyholders or to all st ockholders of an insurer involved,\nthe commissioner is required to give a copy of the order on hearing to the\ncorporation and insurer parties, to intervening parties, to a reasonable number of\nstockholders or policyholders as representative of the class, and to other parties only\nupon written request of such parties.\n(3) A final order may require that restitution be made to any person aggrieved by a\nviolation of any provisions of this chapter, any statute administered by the\ncommissioner, or any regulation of the commissioner.\n(4) An order prepared by the commissioner's designee and approved in writing by the\ncommissioner shall be considered the commissioner's order.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16687","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:37Z","sha256":"49d90abd82b82db756d892c813e3ccfc897c5f5c3978260376d04541ee61561c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.2-350","next":"us-ky/krs-304.2-370"},"notice":"GroundRules: Original legal text.
