{"data":{"id":"us-ky/krs-304.20-041","jurisdiction":"us-ky","citation":"KRS 304.20-041","heading":"Prohibition against insurer's refusing to reissue motor vehicle liability","body":"policy or imposing additional premium because of uninsured status under\ncertain conditions.\n(1) An insurer, with whom a person was most recently insured under a motor vehicle\nliability insurance policy, shall not refuse to issue a policy of motor vehicle liability\ninsurance nor impose an additional premium solely because the person is uninsured\nat the time of reapplication, if the person demonstrates that:\n(a) During the period he was without insurance, he did not own a motor vehicle,\nthe registration on the insured motor vehicle was canceled because he was\nabsent from the Commonwealth, the motor vehicle was out of use, or\ninoperable and under repair, or he was unable to pay the premium renewal due\nto unemployment or other bona fide economic hardship; and\n(b) During the period the person was without insurance, he was not convicted of\nany traffic violation under the laws of the Commonwealth; and the\nreapplication was made within twenty-four (24) months of the nonrenewal of\nthe policy.\n(2) This section shall not be construed to permit the owner of the motor vehicles or any\nother person to operate or to permit the operation of the motor vehicle in this\nCommonwealth until the security has again been provided pursuant to Subtitle 39 of\nthis chapter.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29479","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:50Z","sha256":"fd99404be30b1dd588306685c31678bd736220010d90ec051acf0b5e7f33fc62","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.20-040","next":"us-ky/krs-304.20-0411"},"notice":"GroundRules: Original legal text.
