{"data":{"id":"us-ky/krs-304.20-100","jurisdiction":"us-ky","citation":"KRS 304.20-100","heading":"Loss run statement to be provided upon request -- Duties of insurer and","body":"insurer's agent.\n(1) As used in this section:\n(a) \"Commercial property and casualty\" means any kind of property and casualty\ninsurance relating to commercial risks that is no t insurance for personal risks\nas defined in KRS 304.13-011;\n(b) \"Loss run statement\" means a report relating to commercial property and\ncasualty risks maintained by an insurer containing the history of claims\noccurring within a policy term; and\n(c) \"Provide\" means to mail, personally deliver, or electronically send a\ndocument, or to allow access through an electronic portal to view or generate\na document.\n(2) An insurer shall provide a loss run statement to an insured or an insurer's agent\nwithin twenty (2 0) calendar days of receipt of a written request submitted by the\ninsured or the insurer's agent.\n(3) An insurer's agent that receives a loss run statement pursuant to subsection (2) of\nthis section shall provide a copy of the loss run statement to the ins ured within five\n(5) calendar days of receipt by the agent.\n(4) The loss run statement provided pursuant to subsection (2) of this section shall be a\nfive (5) year loss run history for the prior five (5) years or a complete loss run\nhistory with the insurer if the history is less than five (5) years.\n(5) An insurer's agent that receives a loss run statement pursuant to subsection (2) of\nthis section shall not divulge consumer information to any third party, except in\naccordance with applicable laws governin g the privacy of consumer financial\ninformation, health information, or other information that is otherwise required by\nlaw to be held as confidential.\n(6) An insurer shall not charge any fees to prepare and provide one (1) loss run\nstatement in accordance with subsection (2) of this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40249","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:50Z","sha256":"d790b24d82003d75a6d805f7cd2773441026bf33a284ea10a075fa682f07e7a1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.20-090","next":"us-ky/krs-304.20-105"},"notice":"GroundRules: Original legal text.
