{"data":{"id":"us-ky/krs-304.20-105","jurisdiction":"us-ky","citation":"KRS 304.20-105","heading":"Definitions for section -- Assignment of duties, rights, or benefits --","body":"Prohibition.\n(1) As used in this section:\n(a) \"Insured\" means a person that is entitled, or may be entitled, to receive first -\nparty benefits or payments under an insurance policy;\n(b) \"Person\" includes:\n1. A natural person;\n2. Any type or form of corporation, company, partnership, proprietorship,\nassociation, or other legal entity; and\n3. A government, governmental subdivision or agency, or other body\npolitic; and\n(c) \"Rights or benefits under the policy\" includes the insured's right to receive\nany and all post -loss benefits or payments available or payable under the\npolicy, including but not limited to claim payments.\n(2) An insured under a property, casualty, or property a nd casualty insurance policy\nshall not, either prior to or after a claimed or covered loss, assign or otherwise\ntransfer, in whole or in part, to any other person the insured's:\n(a) Duties under the policy; or\n(b) Rights or benefits under the policy.\n(3) Any contract entered in violation of this section shall be void and unenforceable.\n(4) Nothing in this section shall be construed to prohibit an insured from:\n(a) Directing the payment of benefits under KRS 304.39-241;\n(b) Authorizing or directing payment to, or paying, a person for services,\nmaterials, or any other thing which may be, or is, covered under an insurance\npolicy; or\n(c) Assigning rights to seek damages related to a personal injury or tort case,\narising from a settlement, verdict, or resulting judgment against the insured\nthat is in excess of the insured's liability insurance coverage, subject to\ndefenses available under Kentucky law.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54463","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:50Z","sha256":"81638c17a3f82c8fdff8455470ba5d874be8035d6a9619ed291a49edc5200f8d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.20-100","next":"us-ky/krs-304.20-110"},"notice":"GroundRules: Original legal text.
