{"data":{"id":"us-ky/krs-304.20-340","jurisdiction":"us-ky","citation":"KRS 304.20-340","heading":"Declination or termination prohibited, when.","body":"The declination or termination of a policy of insurance subject to KRS 304.20 -300 to\n304.20-350 by an insurer or agent is prohibited if the declination or termination is:\n(1) Based solely upon the race, religion, nationality, ethnic group, age, sex, or mar ital\nstatus of the applicant or named insured;\n(2) Based solely upon the lawful occupation or profession of the applicant or named\ninsured, except that this provision shall not apply to an insurer which limits its\nmarket to one (1) lawful occupation or pro fession or to several related lawful\noccupations or professions or to an insurer that does not provide the kind of\ninsurance sought by the applicant;\n(3) Based solely upon the age or location of the residence or property of the applicant or\nnamed insured, unless such decision is for a business purpose which is not a mere\npretext for unfair discrimination;\n(4) Based solely upon the fact that another insurer previously declined to insure the\napplicant or terminated an existing policy in which the applicant wa s the named\ninsured;\n(5) Based solely upon the fact that the applicant or named insured previously obtained\ninsurance through a residual market mechanism;\n(6) Based solely upon the fact that the applicant or named insured has previously\nobtained property o r casualty insurance from a carrier providing nonstandard\ncoverage; or\n(7) Based solely upon the fact that the applicant or named insured has sustained one (1)\nor more losses that immediately result from a natural cause without the intervention\nof any person and that could not have been prevented by the exercise of prudence,\ndiligence, and care.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29505","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:50Z","sha256":"7a6451c8ac72a2d2e0da18c31188d412ddc3e1e10caf84073d360ffe0426519b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.20-330","next":"us-ky/krs-304.20-350"},"notice":"GroundRules: Original legal text.
