{"data":{"id":"us-ky/krs-304.29-031","jurisdiction":"us-ky","citation":"KRS 304.29-031","heading":"Representative form of government, defined.","body":"A society shall have a representative form of government if:\n(1) It has a supreme governing body constituted in one (1) of the following ways:\n(a) An assembly composed of delegates elected directly by the members or at\nintermediate assemblies or convention s of members or their representatives,\ntogether with other delegates as may be prescribed in the society's laws. A\nsociety may provide for election of delegates by mail. The elected delegates\nshall constitute a majority in number and shall not have less th an two-thirds\n(2/3) of the votes and not less than the number of votes required to amend the\nsociety's laws. The assembly shall be elected and shall meet at least once\nevery four (4) years and shall elect a board of directors to conduct the business\nof the society between meetings of the assembly. Vacancies on the board of\ndirectors between elections may be filled in the manner prescribed by the\nsociety's laws; or\n(b) A board composed of persons elected by the members, either directly or by\ntheir representa tives in intermediate assemblies, and any other persons\nprescribed in the society's laws. A society may provide for election of the\nboard by mail. Each term of a board member may not exceed four (4) years.\nVacancies on the board between elections may be fi lled in the manner\nprescribed by the society's laws. Those persons elected to the board shall\nconstitute a majority in number and not less than the number of votes required\nto amend the society's laws. A person filling the unexpired term of an elected\nboard member shall be considered to be an elected member. The board shall\nmeet at least quarterly to conduct the business of the society;\n(2) The officers of the society are elected either by the supreme governing body or by\nthe board of directors;\n(3) Only benefit members are eligible for election to the supreme governing body and\nthe board of directors; and\n(4) Each voting member shall have one (1) vote which shall not be cast by proxy.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29651","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:52Z","sha256":"00157e585ab4deec33bffbc7c3fc7748c7bf92995b5d852527efeb77ea135573","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.29-030","next":"us-ky/krs-304.29-040"},"notice":"GroundRules: Original legal text.
