{"data":{"id":"us-ky/krs-304.3-090","jurisdiction":"us-ky","citation":"KRS 304.3-090","heading":"General eligibility for certificate of authority -- Prior operation.","body":"No foreign insurer shall be authorized to transact insurance in Kentucky, which has not\nbeen issuing its own policies as an authorized insurer for at least three (3) years in its state\nor country of domicile, unless the insurer is otherwise qualified for a  certificate of\nauthority under this code and is:\n(1) The wholly owned subsidiary as defined in KRS 304.37 -010 of an insurer which is\nalready an authorized insurer in Kentucky; or\n(2) The successor in interest through statutory merger or statutory consolid ation, or\nthrough bulk reinsurance of substantially all of the insurance risks in this state, of an\nauthorized insurer; or\n(3) An insurer organized solely for the purpose of insuring against earthquake, flood,\nnuclear radiation, war or other special hazard s to property or liability for which, in\nthe opinion of the commissioner, adequate provision is not made by insurers already\nauthorized in this state.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49244","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:37Z","sha256":"01ea64aeb8961be5807e30d4ba376148ee11e050a3f7fe3faa7df130258a4d42","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.3-080","next":"us-ky/krs-304.3-100"},"notice":"GroundRules: Original legal text.
