{"data":{"id":"us-ky/krs-304.3-100","jurisdiction":"us-ky","citation":"KRS 304.3-100","heading":"Name of insurer.","body":"(1) No insurer shall be formed or authorized to transact insurance in this state which\nhas or uses a name which is the same as or deceptively similar to that of another\ninsurer already so authorized, without the written consent of such other insurer.\n(2) No life insurer shall be so authorized which has or uses a name deceptively similar\nto that of another insurer authorized to transact insurance in this state within the\npreceding ten (10) years if life insurance policies originally issued by such other\ninsurer are still outstanding in this state, without the written consent of such insurer.\n(3) No insurer shall be formed or authorized to transact insurance in this state which\nhas or uses a name the same as or deceptively similar to the name of any foreign\ninsurer not so authorized if such foreign insurer has within the next preceding\ntwelve (12) months signified its intention to secure an incorporation in this state\nunder such name, or to do business as a foreign insurer in this state under such\nname, by filing n otice of such intention with the commissioner, unless the written\nconsent to the use of such name or deceptively similar name has been given by such\nforeign insurer.\n(4) No foreign insurer seeking admission to this state shall be authorized to transact\ninsurance in this state which has or uses a name the same as or deceptively similar\nto that of a domestic corporation which has been incorporated as an insurer but has\nnot yet secured a certificate of authority, until the expiration of three (3) years from\nthe date of incorporation of such domestic corporation.\n(5) No insurer shall be so authorized which has or uses a name which tends to deceive\nor mislead as to the type of organization of the insurer.\n(6) In case of conflict of names between two (2) insurers,  or a conflict otherwise\nprohibited under this section, the commissioner may, after notice to the other\ninsurer, permit (or may require as a condition to the issuance of an original\ncertificate of authority to an applicant insurer) the insurer to use in th is state such\nsupplementation or modification of its name or such business name as may\nreasonably be necessary to avoid the conflict.\n(7) Except as provided in subsection (6) of this section, an insurer shall conduct its\nbusiness in the name under which the certificate of authority was issued.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16706","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:37Z","sha256":"fd82c543eae9a8b66603cf68984063370c4730140e37cd1ac2cc4cd2ef641e9e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.3-090","next":"us-ky/krs-304.3-110"},"notice":"GroundRules: Original legal text.
