{"data":{"id":"us-ky/krs-304.3-320","jurisdiction":"us-ky","citation":"KRS 304.3-320","heading":"Guaranty fund deposit by foreign insurers may be required by","body":"commissioner.\n(1) Foreign insurers currently admitted to do the business of life and health insurance in\nKentucky and foreign insurers hereafter admitted to do the business of life and\nhealth insurance in Kentucky which are domiciled in states which have no life and\nhealth insurance guaranty association or similar guaranty fund in operation may be\nrequired by the commissioner, in order to protect Kentucky policyholders, to furnish\nto the commissioner a deposit of cash or publicly -traded securities having a market\nvalue of not less than one hundred thousand dollars ($100,000) nor more than one\nmillion dollars ($1,000,000).\n(2) In establishing the amount of the deposit required by subsection ( 1) of this section\nfor a particular insurer, the commissioner shall consider the following factors:\n(a) The amount of Kentucky writings;\n(b) The amount of policy reserves and claim reserves pertaining to Kentucky\nrisks;\n(c) The kind of insurance written in Kentucky;\n(d) The current financial and operating test results of the insurer provided by the\nNational Association of Insurance Commissioners under its insurance\nregulatory information system; and\n(e) Any other relevant financial data.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16731","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:37Z","sha256":"f47f6756b06f93d8d71e2d68eb82dd55621aa59f9e903bf193f79f54fd23c7a6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.3-315","next":"us-ky/krs-304.3-330"},"notice":"GroundRules: Original legal text.
