{"data":{"id":"us-ky/krs-304.3-700","jurisdiction":"us-ky","citation":"KRS 304.3-700","heading":"Definitions for KRS 304.3-700 to 304.3-735.","body":"As used in KRS 304.3-700 to 304.3-735, unless context requires otherwise:\n(1) \"Applicant\" means a person that has filed an application under KRS 304.3-705;\n(2) \"Beta test\" means the phase of testing of an insurance innovation in the regulatory\nsandbox through the use, sale, license, or availability of the insurance innovation by\nor to clients or consumers under the supervision of the department;\n(3) \"Client\" means a person, other than a consumer, utilizing a participant's insurance\ninnovation during a beta test to carry on some activity regulated by the department;\n(4) \"Director\" means the director of insurance innovation;\n(5) \"Extended no-action letter\" or \"extended letter\" means a public notice setting forth\nthe conditions for an extended safe harbor beyon d the beta test under which the\ndepartment will not take any administrative or regulatory action against any person\nusing the insurance innovation described in the extended no-action letter;\n(6) \"Innovation's utility\" means an evaluation by the commissione r of the insurance\ninnovation's ability to adequately satisfy factors set forth in KRS 304.3-705(1)(b)1.;\n(7) \"Insurance innovation\" or \"innovation\" means any product, process, method, or\nprocedure relating to the sale, solicitation, negotiation, fulfilment, administration, or\nuse of any product or service regulated by the department:\n(a) That has not been used, sold, licensed, or otherwise made available in this\nCommonwealth before the effective filing date of the application, whether or\nnot the product or service is marketed or sold directly to consumers; and\n(b) That has regulatory and statutory barriers that prevent its use, sale, license, or\navailability within this Commonwealth;\n(8) \"Limited no -action letter\" or \"limited letter\" means a letter setting forth the\nconditions of a beta test and establishing a safe harbor under which the department\nwill not take any administrative or regulatory action against a participant or client of\nthe participant concerning the compliance of the insurance innovation wit h\nKentucky law so long as the participant or client abides by the terms and conditions\nestablished in the limited no-action letter;\n(9) \"Participant\" means an applicant that has been issued a limited no -action letter\nunder KRS 304.3-715; and\n(10) \"Regulatory sandbox\" or \"sandbox\" means the process established under KRS\n304.3-700 to 304.3 -735 by which a person may apply to beta test and obtain a\nlimited no-action letter for an innovation, potentially resulting in the issuance of an\nextended no-action letter.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49145","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:38Z","sha256":"8508e6915941dc9b8650840f311d19334509f2794e28d6beff70d5923fa3b383","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.3-635","next":"us-ky/krs-304.3-705"},"notice":"GroundRules: Original legal text.
