{"data":{"id":"us-ky/krs-304.32-130","jurisdiction":"us-ky","citation":"KRS 304.32-130","heading":"Schedule of dues and fees.","body":"The  commissioner shall not issue or renew  a certificate of authority to any\ncorporation operating or proposing to operate a nonprofit hospital, medical-surgical,\ndental, or other health service plan unless:\n(1) The subscription or membership certificates which the corporation offers to its\nsubscribers or members, together with a schedule of the dues and fees to be\npaid by subscribers or members, or the formula for developing dues or fees,\nhas been filed with the commissioner in accordance with KRS 304.32-160.\n(2) The  schedule of the dues and fees to be paid by subscribers or members  is\none which will:\n(a) Enable the corporation to meet its current and ongoing obligations to its\nsubscribers or members  without impairing the guarantee fund required by\nKRS  304.32-140;\n(b) Is established and justified in accordance with those actuarially sound\nfactors deemed relevant by the commissioner;\n(c) Not be excessive, inadequate, or unfairly discriminatory in relation to the\nservices offered; and\n(d) Enable the corporation to achieve and maintain the highest insurance\nindustry financial strength ratings.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46633","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:54Z","sha256":"9b3f24a23a934d5f0c24892ea493d947b47201c674aa902244af53dca32778e9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.32-120","next":"us-ky/krs-304.32-140"},"notice":"GroundRules: Original legal text.
