{"data":{"id":"us-ky/krs-304.32-160","jurisdiction":"us-ky","citation":"KRS 304.32-160","heading":"Forms and schedules of charges -- Filing and approval.","body":"(1) On or after June 18, 1970, no corporation subject to the provisions of this subtitle\nshall deliver or issue for delivery in this state any subscription certificate or\nmembership certificate describing health benefits available, or any indorsement,\nrider, or application which becomes a part thereof, or the schedule of rates, dues,\nfees, or other periodic charges, to be paid by subscribers or members, until a copy of\nsuch form has been filed with and approved by the commissioner.\n(2) At the expiration of thir ty (30) days the form so filed shall be deemed approved\nunless prior thereto it has been affirmatively approved or disapproved by order of\nthe commissioner, or a hearing has been scheduled by order of the commissioner. In\nthe event that a hearing is held, the thirty (30) day waiting period shall begin anew\nafter the close of such hearing. Approval of any such form by the commissioner\nshall constitute a waiver of any unexpired portion of such waiting period. The\ncommissioner may extend by not more than an ad ditional thirty (30) day period\nwithin which the commissioner may so affirmatively approve or disapprove any\nsuch form, by giving notice to the insurer of such extension before expiration of the\ninitial thirty (30) day period. At the expiration of any such  period as so extended,\nand in the absence of such prior affirmative approval or disapproval, any such form\nshall be deemed approved. The commissioner may at any time withdraw any such\napproval. Any notice of the commissioner withdrawing a previous approva l shall\nstate the grounds therefor and the particulars thereof in such detail as reasonable to\ninform the insurer thereof. Any such withdrawal of a previously approved form\nshall be effective at the expiration of such period, not less than thirty (30) days  after\nthe giving of the notice of withdrawal, as the commissioner shall in such notice\nprescribe.\n(3) The commissioner's order disapproving any form or withdrawing previous approval\nshall state the grounds for disapproval or withdrawal.\n(4) The commissioner may, by order, exempt from the requirements of this section for\nso long as he or she deems proper, any document or form specified in the order, to\nwhich in his or her opinion this section may not practicably be applied, or the filing\nand approval of whi ch are, in his or her opinion, not desirable or necessary for the\nprotection of the public.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29792","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:54Z","sha256":"28ec3138468f972c3d6ae8ae220fcb8e53f609cfabbcb9a2a85a53a56017e12a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.32-1595","next":"us-ky/krs-304.32-165"},"notice":"GroundRules: Original legal text.
