{"data":{"id":"us-ky/krs-304.33-050","jurisdiction":"us-ky","citation":"KRS 304.33-050","heading":"Injunctions and orders.","body":"(1) Except as provided in KRS 304.33-052 and 304.33-055, any receiver appointed in a\nproceeding under this subtitle may at any time apply for and any court of general\njurisdiction may grant such restraining orders, temporary and permanent\ninjunctions, and other orders as are deemed necessary and proper to prevent:\n(a) The transaction of further business by or on behalf of the insurer;\n(b) The transfer of property against which the receiver has a claim;\n(c) Interference with the receiver or with the proceedings;\n(d) Waste of the insurer's assets;\n(e) Dissipation and transfer of bank accounts;\n(f) The institution or further prosecution of any actions or proceedings by or on\nbehalf of the insurer;\n(g) The institution or further prosecution of any action against the  receiver or the\ninsurer, including but not limited to interpleader or other actions involving\nassets against which the receiver has a claim;\n(h) The obtaining of preferences, judgments, attachments, garnishments, or liens\nagainst the insurer or its assets;\n(i) The levying of execution against the insurer or its assets;\n(j) The making of any sale or deed for nonpayment of taxes or assessments that\nwould lessen the value of the assets of the insurer;\n(k) The withholding from the receiver of books, accounts, documents, or other\nrecords relating to the business of the insurer;\n(l) Any other threatened or contemplated action that might lessen the value of the\ninsurer's assets or prejudice the rights of policyholders, creditors, or\nshareholders, or the administration of the proceeding; or\n(m) Any suit or other action against a reinsurer of the insurer.\n(2) The receiver may apply to any court outside of this state for the relief described in\nsubsection (1) of this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56202","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:54Z","sha256":"7d7e4afdaa874cadce034a79dfc217287a65ec7550ad5a979067477e5dccb340","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.33-040","next":"us-ky/krs-304.33-052"},"notice":"GroundRules: Original legal text.
