{"data":{"id":"us-ky/krs-304.33-215","jurisdiction":"us-ky","citation":"KRS 304.33-215","heading":"Obligation for unpaid premiums.","body":"(1) An agent, broker, premium finance company, or any other person, other than the\ninsured, responsible for collection and payment of premium shall be obligated to\npay any collected unpaid premium, whether earned or unearned, less any\ncommissions on the earned  portion of the premiums, due to the insurer at the time\npolicies are terminated pursuant to KRS 304.33 -210, except as expressly provided\nin KRS 304.33 -240(6). Credits, setoffs, or both shall not be allowed to an agent,\nbroker, or premium finance company f or any amounts advanced to the insurer by\nthe agent, broker, or premium finance company on behalf of, but in the absence of\npayment by, the insured.\n(2) An insured shall be obligated to pay any unpaid earned premiums due to the insurer\nat the time his poli cy is terminated pursuant to KRS 304.33 -210, subject further to\nany additional earned premium payable in the future which may be calculated by the\nliquidator representing unbilled audit premiums, experience rated premium\nadjustments, or any other similar d eferred premium adjustments provided for under\nthe terms of the insured's policy and which premiums have been apportioned and\nbilled by the liquidator.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29840","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:54Z","sha256":"90672d58b1f4a8a5b2c18a72ecccc171b7dfd869bc71025ab5b081b9e29563d4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.33-210","next":"us-ky/krs-304.33-220"},"notice":"GroundRules: Original legal text.
