No claims of a creditor who has\nreceived or acquired a preference, lien, conveyance, transfer, assignment or\nencumbrance, voidable under this subtitle, shall be allowed unless he surrenders the\npreference, lien, conveyance, transfer, assignment or encumbrance. If the avoidance\nis effected by a proceeding in which a final judgment has been entered, the claim\nshall not be allowed unless the money is paid or the property is delivered to the\nliquidator within thirty (30) days from the date of the entering of the final judgment,\nexcept that the court having jurisdiction over the liquidation may allow further time\nif there is an appeal or other continuation of the proceeding.\n(2) Time for filing. A claim allowable u nder subsection (1) of this section by reason of\nthe avoidance, whether voluntary or involuntary, of a preference, lien, conveyance,\ntransfer, assignment or encumbrance may be filed as an excused late filing under\nKRS 304.33-360 if filed within thirty (30)  days from the date of the avoidance or\nwithin the further time allowed by the court under subsection (1) of this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29851","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:55Z","sha256":"d8c1e2bc666eee11ac2d2897b2841e3d06505a7d702de2b7d2857b9b3aed69c6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.33-310","next":"us-ky/krs-304.33-330"},"notice":"GroundRules: Original legal text.
